In the UAE, the Ministry of Human Resources and Emiratisation (MoHRE) has implemented a new system that allows domestic workers and employers to withdraw absconding reports in specific circumstances. This initiative comes as hiring domestic workers becomes increasingly common, accompanied by a rise in reports of workers absconding.
Why Withdraw an Absconding Report?
There may be cases where domestic workers return or have valid reasons for their absence. Additionally, some complaints might be lodged wrongfully, leaving domestic workers unfairly accused. The new process by MoHRE enables both parties to withdraw such complaints to rectify these situations.
Procedure for Domestic Workers
Domestic workers can initiate the withdrawal process through MoHRE's website, mobile application, or by visiting designated domestic worker centers or Tawseel vehicles. However, this service is not available in Dubai through MoHRE; those in Dubai must go through the General Directorate of Residency and Foreigners Affairs - Dubai.
Required Documents:
-
Emirates ID of the domestic worker
-
Passport copy of the domestic worker
Conditions:
-
A residence visa is required, regardless of its validity.
-
A record of an absconding report must exist in the system.
The worker must complete the necessary forms, pay a fee of Dh115 online or up to Dh72 at business centers, and await a verification call from the ministry. If approved, the complaint can be canceled within a week.
Procedure for Employers
Employers can also withdraw absconding reports via MoHRE’s website, mobile application, or by visiting Tasheel, Tadbeer centers, or Tawseel vehicles. In Dubai, the process must be done through an Amer center or the General Directorate of Residency and Foreigners Affairs - Dubai.
Required Documents:
-
Emirates ID of the domestic worker
-
Passport copy of the domestic worker
Conditions:
-
A report must be filed in the system by the employer against the worker for absence.
Employers must submit an application, pay the fees, and the ministry will verify the details. If everything checks out, the case is referred for final approval. The process takes about three working days.
This updated policy provides a streamlined process for both employers and domestic workers to resolve absconding issues amicably, preventing potential legal conflicts and ensuring fair treatment.
