Dubai: In a landmark ruling, the Dubai Rental Disputes Center has ordered a landlord to pay Dh700,000 in compensation to a tenant after it was found that the landlord had manipulated legal procedures to wrongfully evict the tenant. The compensation amount is equivalent to three years’ rent.
Case Overview
The dispute involved a European tenant who had fully paid the annual rent for the 2023-2024 lease period to the original property owner. However, when the villa was sold to a new landlord, the new owner falsely claimed the rent had not been paid and initiated a legal case seeking the tenant’s eviction.
To strengthen the false claim, the new landlord deliberately provided an incorrect email address for the tenant when filing the case. As a result, the tenant never received court notifications and was issued a default eviction ruling along with rent arrears.
Enforcement Actions Against the Tenant
Following the initial ruling, the landlord swiftly enforced the eviction, taking the following actions:
- Changing the villa’s locks
- Removing all furniture from the property
- Requesting the court to impose a travel ban and financial restrictions on the tenant
Upon returning from an annual vacation, the tenant was shocked to find himself locked out of his home, completely unaware of the legal case against him.
Tenant Fights Back and Wins Case
Once the tenant discovered the legal actions taken against him, he sought legal assistance and successfully proved the landlord’s misconduct.
After a thorough investigation, the Dubai Rental Disputes Center overturned the eviction order and annulled all related enforcement actions. Additionally, the tenant filed a lawsuit for damages, citing:
- Financial losses
- Legal expenses
- Hotel accommodation costs
- Emotional distress
Following the review, the court ruled in favor of the tenant, awarding him Dh700,000 in damages and restoring his right to the villa.
Landlords Warned Against Deceptive Practices
Judge Abdul Qader Mousa Mohammed, Chairman of the Dubai Rental Disputes Center, reaffirmed the center’s commitment to protecting the rights of both landlords and tenants. He warned landlords against engaging in unethical eviction tactics for financial gain, emphasizing that such practices could result in severe legal and financial consequences.
"Landlords must follow the legal process honestly. Any attempt to manipulate the system for personal gain will not be tolerated," Judge Mohammed stated.
He also advised tenants to ensure rental payments are well-documented and to use official communication channels when dealing with landlords. This, he noted, is crucial in resolving disputes effectively.
